Nicaragua brought a case against Germany to the International Court of
Justice (ICJ) on March 1, 2024, alleging that Germany's financial and military
support to Israel has contributed to acts of genocide against Palestinians in
Gaza. Nicaragua claimed that Germany's cessation of funding to the UN
Palestinian Refugee Agency (UNRWA) and continued arms sales to Israel violated
international humanitarian law and the Genocide Convention.
The ICJ held hearings on Nicaragua's request for provisional measures on April 8
and 9, 2024. Nicaragua sought immediate measures to suspend German military aid
to Israel and to resume funding to the UNRWA. The ICJ noted the significant
decline in German military assistance to Israel, which was reduced from $200
million in October 2023 to approximately $1 million by March 2024. The majority
of these deliveries were for non-war-related equipment.
On April 30, 2024, the ICJ ruled against Nicaragua's request for provisional
measures with a 15-1 vote, citing insufficient grounds to warrant such actions.
The ICJ concluded that the facts presented by both parties "are not such as to
require the exercise of its power … to indicate provisional measures." Despite
this ruling, the Court emphasized ongoing concerns about the humanitarian
situation in Gaza. It reiterated the obligations of states under international
law to prevent and address human rights violations.
